New Tourist Rental Regulations in Andalucía: What Property Owners & Property Management Companies Need to Know in 2026

With the Tourist Rental Registry coming into effect in 2025, as discussed in our previous post, Andalucía’s short-term rental market is undergoing further regulatory changes. The new regulations from the Junta de Andalucía, effective from November 2024, aim to balance tourism growth with local housing needs while raising standards for tourist accommodations.

Whether you own an Airbnb, manage vacation rentals, or operate multiple short-term properties, understanding these new requirements is essential to ensure legal compliance and long-term profitability.

Key Changes for Tourist Rentals in Andalucía

1) Mandatory Registration for Tourist Use
  • All short-term rental properties must now be officially registered as Vivienda de Uso Turístico (VUT). Failure to register can result in fines of up to €18,000.

2) Municipal Control Over Tourist Rentals
  • Local municipalities have greater authority to regulate the number and location of tourist rentals. Depending on the area, restrictions may limit new licenses or impose rental caps to ensure housing remains available for residents.

3) Professionalization of Tourist Rentals
  • New regulations increase service standards, requiring property owners and management companies to meet specific quality, safety, and operational requirements.

4) Publicly Protected Housing Restriction
  • Properties under public protection regulations cannot be used for tourist rentals, preventing economic or professional activity within these homes.

5) Defined Operating Periods
  • Tourist rentals can only be marketed during specified periods, as declared in the Andalusian Tourism Registry. Renting outside of these periods will be considered illegal activity.

New Hosting & Management Responsibilities

To operate legally, hosts and property management companies must meet stricter compliance and reporting requirements. This includes:
1) Guest Documentation & Payment Records
  • Hosts must provide written confirmation of all bookings, including pricing, duration, and registration number.
  • Secure key handover procedures must be followed—if using a safe box, it cannot be placed in a public area.

2) Operational Compliance
  • Hosts must declare rental periods and ensure properties meet new habitability and safety standards.
  • Tourist rental records must be publicly accessible, excluding private contact details.

These measures aim to increase transparency, reduce illegal rentals, and professionalize the short-term rental market.
